Abschlussklausur zum Erwerb des Sprachscheins nach JAPO voraussichtlich  am 11.2.2020

Die Veranstaltung dient zum Erwerb des Sprachscheins. Voraussetzung sind Grundkenntnisse der Spanischen Sprache auf dem Niveau A2. Anhand von Texten und anderen Materialien werden die Grundzüge des spanischen Strafrechts und das dazugehörige Vokabular vermittelt. Außerdem wird die Gelegenheit genutzt, über aktuelle Strafprozesse in Spanien und Lateinamerika zu diskutieren. Die Veranstaltung wird mit einer mündlichen Prüfungsleistung oder einer Klausur abgeschlossen werden. Das Bestehen der Prüfung ist zum Erwerb des Sprachscheins notwendig.

Jeder Staat gibt sich im Laufe der Geschichte eine ganz besondere, unvergleichbare Ordnung. Sie mag zwar dem Grunde nach mit anderen staatlichen Ordnungen ähnliche Elemente aufweisen. Wesentliche, die Verfassungsrealität prägende Merkmal hat sie aber unverwechselbar für sich. Sie sind ebenso Resultat ihrer verfassungsrechtlichen, wie auch ihrer gesellschaftlichen Hintergründe. Das gilt für das Grundgesetz, also die deutsche Verfassung, genauso wie für andere. Entscheidend sind die Verfassungen, weil normhierarchisch nachfolgende gesetzliche Regelungen in einem Abhängigkeitsverhältnis zueinander stehen.

Ganz besonders gilt dies für das Verfassungs- und das Verwaltungsrecht. Nicht ohne Grund wird das Verwaltungsrecht auch als konkretisiertes Verfassungsrecht betitelt. Die Veranstaltung will einen guten Überblick über das Verfassungs- und Verwaltungsrecht Deutschlands geben. Anhand von Beispielen aus der Rechtsprechung des Bundesverfassungsgerichts und anderer Gerichte werden die Inhalte veranschaulicht. Gleichzeitig soll, wo möglich, im Vergleich mit anderen staatlichen Ordnungen, der status quo hinterfragt werden. Insbesondere Erasmus+-Studierende sind eingeladen, sich in Absprache mit dem Dozenten an einem Vergleich der Verfassungsordnungen zu versuchen.

In the course of history, every state develops a unique constitutional regime. The basic principles of this regime might show similar elements to other state orders. Nonetheless, some essential elements always distinguish one order from the other. In those specific characteristics, one may find the constitutional as well as the social historical evolution of a society. This principle applies to the German Grundgesetz as much as for any other constitutional regime. The regime founded by a constitution not only determines the basic understanding of social cohabitation, it also inevitably influences the relationship between citizens and state institutions, which defines the administrative law of the state. Not without reason is there a dictum that states that administrative law is substantiated constitutional law.

The course’s aim is to provide the participants with a basic overview of German constitutional and administrative law. Looking at fundamental or landmark judgements, especially of the Federal Constitutional Court and the Federal Administrative Court, the course tries to discuss the specific characteristics and history of German Constitutional and Administrative Law. By knowing the Constitutional and Administrative system we can challenge the legal status quo. Especially Erasmus+-Students are invited to the discussion by comparing the rules of their home country with those of the Grundgesetz.

This class will provide students with an understanding of the international human rights system as established by the United Nations and grounded in the Universal Declaration of Human Rights. The first half of the course will cover the formation and doctrine of human rights law, looking at both civil & political rights and economic, social and cultural rights. The second half of the course will focus on enforcement, including discussion of treaty bodies, UN Special Procedures and interaction with regional human rights bodies like the European Court of Human Rights.
