This course introduces the fundamentals and contemporary challenges of International Humanitarian Law (IHL), the body of law governing armed conflicts. It explores the historical development and codification of IHL, its scope of application in international and non-international armed conflicts, and its core principles such as distinction, proportionality, and necessity. Students will study the status and protection of combatants, civilians, medical personnel, and humanitarian actors, as well as the regulation of means and methods of warfare, including prohibited weapons. Special attention is given to the interplay between IHL, International Human Rights Law, and International Criminal Law, and to the mechanisms for implementation and enforcement through the ICJ, ICC, and hybrid tribunals. A central component of the course is the presentation and discussion of case law, enabling students to critically engage with judicial reasoning and apply IHL to concrete situations. Successful participants will receive a Sprachschein and are required to submit a final essay at the end of the course.

Die dreitägige englischsprachige Veranstaltung gibt zunächst einen Überblick über das englische Rechtssystem. Anschließend werden die Besonderheiten von Urteilen der englischen Gerichte, im Vergleich zu den deutschen Urteilen, dargestellt und der Aufbau anhand von Beispielen erörtert. Im gemeinsamen Diskurs wird die Stellung des Richters im englischen Rechtssystem erarbeitet. Ein weiterer vergleichender Fokus liegt auf der Struktur von wissenschaftlichen juristischen Texten. Der zweite Hauptteil der Veranstaltung beschäftigt sich mit aktuellen Problemen des IP- und IT-Rechts. Die Erarbeitung des Stoffes erfolgt anhand von aktuellen Fällen, die die Teilnehmer bearbeiten und der Gruppe präsentieren. Abschließend erfolgt eine Diskussion über die aufgeworfenen Problemfelder.
